1. Acceptance
This website is operated by SportTech Gem Holdings, 5000 Stadium Way, Suite B, Los Angeles, CA 90001, United States. By accessing it you agree to these Terms and Conditions. If you do not agree, please do not use the site.
2. No offer, no advice
Nothing on this website is an offer to sell, or a solicitation of an offer to buy, any security, fund interest or other financial instrument, and nothing here should be read as investment, legal, tax or accounting advice. Any offer of an interest in a fund managed by the firm would be made only to eligible investors, only in jurisdictions where such an offer is lawful, and only through formal offering documents that would supersede everything on this site.
Descriptions of our practice areas and process describe how we generally work. They are not a commitment to invest, to invest on particular terms, or to continue any approach described here.
3. Unsolicited submissions
We welcome enquiries from founders, and we read them. However, material sent to us without a signed agreement is received on a non-confidential basis. Please read this section before sending anything.
Do not send us trade secrets, source code, unpublished patent material, athlete personal data or documents covered by another party’s non-disclosure agreement before we have agreed in writing to receive them. Send a description of what you have built instead.
By sending unsolicited material you agree that: we are under no obligation of confidentiality in respect of it; we may already be evaluating or invested in companies with similar ideas, and nothing in your submission restricts us from continuing to do so; and we acquire no obligation to review, respond to, or return the material. You confirm that you are entitled to send it and that doing so does not breach an obligation you owe to someone else.
You retain ownership of your material. You grant us a limited licence to store, read and internally circulate it for the purpose of evaluating a possible investment and for our record-keeping obligations, as described in our Privacy Policy.
4. Intellectual property
The content of this website — text, layout, typography, photographs, illustrations, the SportTech Gem name and mark, and the underlying code — is owned by us or licensed to us. You may read it, print it and quote short extracts with attribution and a link. You may not republish substantial portions, use the material commercially, or use our name or mark in a way that suggests endorsement, without written permission.
Photographs on this site are licensed stock imagery used for illustration. They do not depict our offices, our staff, or any company in which we have invested unless expressly stated.
5. Accuracy and availability
We take care with what we publish, and our Perspectives articles reflect the view of the investment team at the date shown. Views change. We do not undertake to update any article, and you should not rely on a dated piece as a current statement of our position.
The site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free, and we may change, suspend or withdraw any part of it without notice.
6. External links
Where we link to another website, we do so because we found it useful at the time. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.
7. Limitation of liability
To the fullest extent permitted by law, we exclude liability for any indirect, incidental, special or consequential loss, and for any loss of profit, revenue, business, goodwill or anticipated saving, arising from your use of or inability to use this website or from reliance on anything published on it. Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
8. Acceptable use
You agree not to use this site unlawfully; not to attempt to gain unauthorised access to any part of it or to the systems that host it; not to introduce malicious code; not to scrape it at a rate that degrades service for others; and not to use the enquiry form to send unsolicited commercial messages. We may block access where we reasonably believe any of these has occurred.
9. Changes to these terms
We may revise these terms from time to time. The version published here is the one that applies, and the date at the top of the page shows when it last changed. Continued use of the site after a change means you accept the revised terms.
10. Governing law
These terms and any dispute arising out of them are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. The state and federal courts located in Los Angeles County, California shall have exclusive jurisdiction, and you and we submit to that jurisdiction. Nothing in this clause deprives a consumer of the protection of mandatory provisions of the law of their country of residence.
